I’ve never really thought much about minimum sentencing, and as I think about it, I can see both pros and cons, and they each depend on your viewpoint. The judge has to impose at least the minimum upon conviction, which limits the judge’s discretion, but also prevents the judge from imposing sentences based on emotions or outside factors. An outside factor would be political pressure to reduce sentences due to overcrowding. My experiences with the court system come through DSS court, which is civil court, but in a lot of the cases I see where judicial discretion can be and is used based on politics or emotions, and these arbitrary decisions do little to help the family.
